O2 Capping 3G rates and Microsoft Yahoo! AOL and Google

There are two articles in the press today that I am just going to link to as they very interesting. But they are also a tad confusing.

If Google and Yahoo! join that is a cartel no?
The other one I found in my inbox from moconews newsletter and then links to The Register Register (http://www.theregister.co.uk/2008/04/09/o2_speed_limits/). Basically O2 seems to be capping rates for 3G to 128k if you are on a under GBP 20 package.
Is this legal? But will consumers know or care?
